Heirs to a Trust/Estate seem to inherit a gross sense of entitlement for things they did not work for, things they did not earn, or have a sense of stewardship.  Heirs forget how lucky they are to even have been remembered in a Trust/Estate.  Heirs seem to forget the passing of the loved one and put more focus on the loved one's possessions.  With the passing of the loved one, Heirs may have harbored negative feelings pertaining to family members/or past incidences that may surface at this time, creating an atmosphere that disrupts the family continuity. If bad enough, family members may be forced to pick sides within the family.  Family mistrust may include accusations of theft of assets, dislike of selected Trust/Estate Trustee, all taking  a toll on the entire family unit. Negative family accusations, once said, can't be erased and ultimately leads to little no hope for forgiveness.

Pre-planning

Before a Trust is needed we will help you understand a Trust. We will assist you in helping gather information, organize, and educate you on how these steps will be important factors later when the Trust is executed.

 

Education

 

We will assist you in sitting down with the family and explaining the roles and and legal steps involved when the Trust is executed. We will prepare the Trustee on what to expect regarding the family transparency and the fiduciary responsibilities.

Professional Trustee

 

Setting a standard of transparency with monthly reports, including a log report to all beneficiaries that will keep everyone updated and part of the Trust process. Our goal is to execute the Trust legally and respectively to ensure the family is heard and to minimize the past harbored personal feelings that may occur. We handle not just the administrative duties but assist in the selling of properties and  place the correct professional services through our extended network.   

    

 

Assist Trustee

 

Logistics of location, time, knowledge of running a business all can be factors to where the Trustee will require assistance from a professional experienced service. We also can help align them with the proper professional services to help execute the Trust.     

FAMILY MATTERS THE MOST ABOVE ALL

Every family has their own unique dynamics with multiple family personalities involved.  Each family member has gone through life creating their own experiences/perceptions in their life.   And with the sudden loss of a loved one, the family dynamics could change again because the loved one is gone (and may have been the "glue" of the family) and money is involved.   Upon the family grieving, the loved one's Trust/Estate has to be opened, and the Trustee has to take control.  But when the Trustee takes control, the Trustee may have had no education on how and what the Trust/Estate means, what are Trustee's responsibilities, and what Trustee liabilities are involved.  The most critical of executing the Trust/Estate is executing while dealing with all beneficiaries (being family members).  Disruptive variables can include:    family personalities negative reaction towards the Trust/Estate; family members involved don't like the Trustee, siblings harbor past feelings unresolved, sibling rivalries, first-born not being selected as Trustee, etc.  And with all of those family variables, now you add inheritance money; the family could literally fall apart and disconnect.  At Trust in Families we are hear to create preventive steps that could save a family from falling apart.  And when the loved one passes away, the Trust in Families is available to assist the Trustee in executing the Trust/Estate.

EXECUTING A TRUST / Estate

 Managing a family Trust can be a daunting task, especially if the Trustee lacks knowledge of financial and legal experience.  Selected Trustee essentially will be running a business which will consume a lot of hours the Trustee duties completion.  The Trustee will have to travel to the state where the Trust/Estate is being executed (which is the state where the loved one's primary residence is located). The Trustee would have to meet with possible professionals (Trust/Estate attorney, Trust/Estate CPA, etc.) needed to execute the Trust/Estate in the designated state (may require travel).
